Like all other refugees, children’s claims to legal protection under U.S. asylum laws are governed by the 1951 UN Refugee Convention and the 1967 Protocol Relating to the Status of Refugees, to which the United States is a party. Children flee violence and persecution for the same or similar reasons as adults. 

However, these children also flee their native countries for other reasons that are unique to their status and experiences as children.   • Consultation. Children seeking asylum are some of the most vulnerable members of our community. This is accomplished by having one of our immigration lawyers talk to the child and the child’s parents or guardian. 
  • Strategy. At the conclusion of this initial consultation, we will come up with a strategy to pursue and get asylum approved for the child. This typically involves the preparation and filing of paperwork with the U.S. Citizenship and Immigration Services (USCIS), the agency that handles cases like this.
  • Filing. Once we have received all the necessary information and documents concerning the child’s application for asylum, we prepare and file the required documents with USCIS. These documents include evidence and a compelling case we prepare to make it easy for an immigration officer reviewing the application to approve it.

After submitting the application, we monitor for any developments in the processing of the application and keep the child or their guardian informed about the progress. When the application is approved, and asylum is granted, we help guide the child on the next steps to be taken to obtain permanent residency in the U.S. as an asylee.
